Welcome to Elmora. These Terms of Service govern your use of our website at elmorea.com and any related services offered by Elmora.

1. Services Overview

Elmora provides Technology sector legal counsel and intellectual property protection for software and hardware developers. By engaging with our services, you agree to comply with these terms.

2. Acceptance of Terms

By accessing or using our website and services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.

3. Use of Services

• Clients must provide accurate and complete information when requesting services.
• All communications and materials provided to Elmora must comply with applicable laws and regulations.
• Unauthorized use or redistribution of our materials is prohibited.

4. Fees and Payment

Fees for services, information products, and goods are as specified on elmorea.com or in separate agreements. Payment is due according to the schedule provided in the engagement letter or order confirmation.

5. Refund Policy

Elmora aims to ensure client satisfaction. The policy below outlines eligibility and procedures for refunds or rescheduling.

5.1 Legal Counsel Services

• Cancellations made more than 7 days before a scheduled consultation are eligible for a full refund of paid fees, minus an administrative charge of 10%.
• Cancellations within 7 days of the scheduled consultation are not eligible for a refund; however, you may reschedule one session if requested at least 48 hours in advance.
• If substantive work has commenced on your behalf prior to cancellation, all fees paid are non-refundable due to the time and expertise allocated.
• Approved refunds will be returned to the original payment method within 14 days of approval.

5.2 Information Products

• For digital materials and publications, you may request a refund within 7 days of purchase, provided access has not been granted or downloads have not occurred.
• Once access to the digital content is granted or downloads have commenced, refunds are not available, due to the nature of digital delivery and intellectual property protection.
• Approved refunds will be returned to the original payment method within 14 days of approval.

5.3 Physical Goods

• To return a tangible product, notify Elmora within 30 days of receipt. Items must be unopened and in original packaging.
• Clients are responsible for return shipping costs. Once the returned item is received and inspected, the product cost will be refunded to the original payment method within 14 days.
• No refunds will be issued for items that are damaged, soiled, or missing original packaging.

6. Intellectual Property

All content, materials, and deliverables provided by Elmora remain the intellectual property of Elmora unless otherwise specified in a separate agreement. Clients receive a limited license to use deliverables for the intended purpose.

7. Limitation of Liability

To the fullest extent permitted by law, Elmora’s liability for any claim arising under these Terms of Service is limited to the amount of fees paid by the client for the specific service giving rise to the claim. Elmora is not liable for indirect or consequential losses.

8. Governing Law

These Terms of Service are governed by and construed in accordance with Swiss law. Any dispute arising under these terms shall be subject to the exclusive jurisdiction of the courts of Zurich, Switzerland.
